Introduction

These Terms of Service ("Terms") govern your access to and use of the CreatorsBest platform available at www.creatorsbest.com ("CreatorsBest", the "Platform"), operated by:

CreatorsBest is an online platform on which verified content creators ("Creators") publish and monetize exclusive digital content, and registered users ("Fans") can view content, communicate with Creators, and purchase digital credits ("Credits") to unlock content and features.

By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Platform.

1. Eligibility

You must be 18 years or older to use the Platform. By using CreatorsBest, you confirm that you meet this requirement and have the legal capacity to enter into a binding agreement.

2. Account Registration, Security & Identity Verification

To access certain features, account creation is required. You agree to:

• Provide accurate, current, and complete information.
• Keep your credentials secure.
• Notify us immediately of any unauthorized access.

Creators must complete a mandatory identity and age verification before publishing content. We use trusted third-party verification providers for this purpose; by registering as a Creator, you consent to the processing of your data by our verification providers.

We reserve the right to suspend or terminate accounts violating these Terms.

3. User Conduct, Content Guidelines & Responsibilities

3.1 Prohibited Content & Activities

You MUST NOT upload, share, or engage in content or actions involving:

• Minors (persons under 18)
• Violence, abuse, or non-consensual acts
• Hate speech, racism, discrimination
• Animals
• Feces or human waste (coprophilia)
• Illegal activities (under any jurisdiction)
• Drugs (use, promotion, sale)
• Gambling or betting services
• Malware distribution or security breaches
• Intellectual property infringement
• Content depicting persons who have not given informed consent to its production and publication

We enforce a zero-tolerance policy. Violations result in immediate content removal, account termination, and potential legal action. See also our Complaints & Content Removal Policy and our 18 U.S.C. §2257 Compliance Statement.

3.2 User Declaration

By using the Platform, you confirm:

• Compliance with all content rules.
• You own or have rights to all uploaded content.
• All persons depicted in your content are 18+ and have given informed consent.

3.3 Creator Consent Records & Documentation

The following obligations apply to every Creator for all content uploaded to the Platform, including live streams and profile pictures:

• Written consent records: The Creator must obtain and keep on record written consent from every person depicted in the content, covering each of the following separately: (i) consent to be depicted in the content; (ii) consent to the public distribution of the content and to its upload to the Platform; and (iii) where the content can be downloaded by other users, consent to such downloading.
• Age and identity verification: The Creator must verify the identity and age of every person depicted in the content by means of a government-issued identification document and ensure that all depicted persons are adults (18+).
• Supporting documents: The Creator must retain the consent records and verification documents for as long as the content is available on the Platform and for at least seven (7) years thereafter, and must provide them to PUBLIbusiness24 AG upon first request (for example, in the context of a complaint, an audit by a payment scheme, or a request by a competent authority).
• Withdrawal of consent: Any person depicted in content may request its removal at any time via our Complaints & Content Removal Policy. If valid consent cannot be demonstrated, or consent is void under applicable law, the content is removed with immediate effect.

Failure to produce the required documentation upon request is treated as a material breach of these Terms and results in immediate removal of the affected content and, in serious or repeated cases, termination of the Creator account.

4. Intellectual Property Rights

By uploading content, you grant PUBLIbusiness24 AG a non-exclusive, worldwide, royalty-free license to use, display, distribute, and promote your content within the Platform.

• You retain ownership of your IP.
• We receive the rights necessary to operate and market the Platform.
• Unauthorized third-party content is prohibited.
• Deleting content ends future usage rights, though backups may be retained for legal compliance.

Content purchased or unlocked on the Platform is licensed to you for personal, non-commercial use only. Downloading, re-distributing, or re-selling Creator content is strictly prohibited.

5. Credits, Payments & Transactions

Certain features require Credits, which can be purchased on the Platform. All payments are processed securely by certified third-party payment providers; we do not store sensitive payment data. Depending on the payment method, the name of the payment provider may appear on your bank or card statement instead of "CreatorsBest".

• Prices and the Credit amounts they correspond to are displayed before every purchase.
• Credits are a prepaid balance for use on the Platform only; they are not legal tender, bear no interest, and are not transferable between accounts.
• Refunds are handled according to our Refund Policy.
• You are responsible for any applicable taxes and fees in your jurisdiction.

6. Data Protection & Privacy

Your personal data is handled in accordance with our Privacy Policy, in compliance with the EU General Data Protection Regulation (GDPR), the Swiss Federal Act on Data Protection (FADP), and other applicable laws. We implement strong security measures, including encryption, fraud detection, and regular audits.

7. Termination

We may suspend or permanently ban your access without notice if you:

• Violate these Terms.
• Engage in harmful conduct toward other users or our business.

8. Disclaimers & Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We disclaim all express or implied warranties, including merchantability and fitness for a particular purpose.

We are not liable for:

• User-generated content.
• Indirect, incidental, or consequential damages arising from use of the Platform.

9. Governing Law & Dispute Resolution

These Terms are governed by Swiss law. Any disputes shall be resolved exclusively in the courts of Zug, Switzerland.

10. Amendments

We may update these Terms at any time. Significant changes will be posted on the Platform. Continued use constitutes acceptance of the revised Terms.
